8. BOGUS FCC : Yes, we know of those companies selling USB
interface units which have either failed or have bogus FCC certification. As they claim they are certified why
not request a copy of their so-called "FCC certification"? If you purchased a Navigator we'll send
you a copy of ours. It's 30+ pages, so you pay the postage. Is that fair enough?
After we
pulled our advertising from CQ, an agent of the magazine told us they accept the illegal sellers advertising without
asking for FCC compliance "because they are neither gatekeepers nor policemen so it's not their responsibility". We
thought CQ's primary responsibility was to help and protect the ham? To our knowledge this magazine has received
more than one complaint about this. Is it fair for a company to knowingly and willingly accept advertising
dollars from
sellers violating US and other laws? Is the trusting ham being protected? No, but
the illegal seller's ad dollars are accepted at the cost of the trusting ham.
Does anyone remember the "good old days" when ham radio antenna companies advertised their tri-element tri-band beams as
having better than 32dB gain on 20 meters? Of course they didn't tell you it was 32dB oawn (over a wet noodle).
(Hey, wanna buy some 6dB oil fer yer tenna?) Finally, the ARRL cracked down and would not allow the antenna
manufacturers to publish those blatant lies in QST. Soon after, other magazines (like CQ) followed in QST's footsteps.
So,
what's your point? Try this: "Oh yes, we're FCC certified", says the wanna-be advertiser. "No problem",
say QST's ad lady, "Just send us a copy of your FCC certification and you can advertise in a magazine that looks out for
the ham!" Utopia? Maybe not. The ARRL did it before with the antenna companies.
BTW: We supplied CQ,
QST and World Radio Magazine complete copies of our FCC certifications and lab test reports before we began advertising
with them.
About 85% of the advertisers in ham magazines are "cottage industries".
We are one of those 85% and we are firm believers in the American way. We openly welcome free trade and competition.
It's good for the ham radio operator as it keeps product quality high, prices low and gives John Doe Ham the ability
to make an educated choice...
....or.....does it? ......
John Doe ham can only make an educated choice
when competitors are playing on a level playing field. John Doe ham thought all the companies were legal
because they were advertising in CQ and he was sure that magazine would never allow illegal sellers to advertise. John
Doe ham just got thrown under the bus.
It doesn't matter how bad or how good these off-shore units
operate or how much RFI they cause (some of them cause a lot). What only matters is the fact that they are illegal here in the
USA and still allowed advertising in CQ. Why didn't CQ require a copy of the FCC Class B certification before
advertising? Money.
Under FCC and US law, any company selling a USB digital device must have the
required FCC Class B certification BEFORE it is brought to market. A product can not be advertised for sale
until the FCC certification has been successful and documented. There is no such thing as, "We will have
FCC approval in a few weeks so we can ship it to you now." Or, "We did the 'self certification' process so
we don't need FCC Class B certification for a USB Digital Device. That's a crock of bull. Nope, no such thing, not
even in Canada, eh! It's against the law.
